Tom McGinnis Excavating & Plumbing Residential & Commercial SNOWPLOWING Call Us At 585-768-6769 Police Report Over the weekend, Officers from the Le Roy Police Department assigned, to road patrol as well as Officers assigned to the STOP DWI Holiday Crackdown, a special enforcement effort to crackdown on impaired driving, made several arrests involving impaired drivers. In the late afternoon of December 15, 2018 members of the Le Roy Police Department responded to a local grocery store after receiving a complaint that a female had just driven to the store in an intoxicated state. Patrols responded to the store and located 57 year old, Linda B. Towner of Batavia, New York, near the vehicle it was alleged she had been operating. After a brief investigation patrols believed Towner had operated the vehicle prior to it being parked in the parking lot of the store. Towner was found to be intoxicated and arrested without incident. Towner was charged with one count of Driving While Intoxicated and one count of Operating a Motor Vehicle with a BAC of .08 of 1% or More, both are Misdemeanors. Later in the evening on the same date, patrols observed a vehicle allegedly operating at a high rate of speed in the Village of Le Roy, at the time of operation the driver’s view was also obstructed. Patrols executed a lawful traffic stop on the vehicle and identified the operator as 46 year old, Scott M. Hoover of Bloomingdale, Ohio. Following a brief investigation Hoover was found to be operating the vehicle in an intoxicated state. Hoover was subsequently placed under arrest and charged with one count of Driving While Intoxicated, a Misdemeanor, Operating a Motor Vehicle with a BAC of .08 of 1% or More, a Misdemeanor, Speed in Zone, a Violation, and Driver’s View Obstructed. In the evening of December 16, 2018 patrols observed a vehicle operating all over the roadway, the operator of the vehicle was allegedly unable to maintain the designated driving lane, the vehicle moved so far outside of the lane that the tires struck the curb on the side of the roadway. At one-point patrols observed the vehicle occupying both lanes of the highway. As a result of the patrols observation of the operation of the vehicle, the vehicle was stopped and 42 year old, Jeremy J. Trzecieski of Pavilion, New York, was identified as the operator. During the traffic stop and the brief investigation that followed, Trzecieski was found to be consuming an alcoholic beverage while operating the motor vehicle. During the investigation patrols believed Trzecieski to be intoxicated and he was subsequently arrested for such. Trzecieski was charged with Driving While Intoxicated, a Misdemeanor, Aggravated Driving While Intoxicated (driving with a BAC of .18 or higher), a Misdemeanor, Consumption of Alcohol in a Motor Vehicle, a Violation, Failure to Use Designated Lane, a Violation, and Improper Left Turn, also a Violation. Towner, Hoover, and Trzecieski were all issued appearance tickets as the result of their arrests. All are to appear in the Le Roy Town Court of January 17, 2019 to answer to their charges. 24 year old, Kayne W. Probst of Lynn, Massachusetts, was arrested by the Le Roy Police Department on December 13, 2018 and charged with one count of Petit Larceny, a Class AMisdemeanor. On December 13, 2018 members of the Le Roy Police Department received a complaint of a larceny that had just occurred at a local store, it is alleged that Probst took merchandise from the store without paying. After a brief investigation combined with information provided by the complainant, Patrols were able to identify and locate Probst. Probst was taken into custody without incident. Probst was arraigned in the Le Roy Town Court in front of the Honorable Judge Sehm and turned over to the Genesee County Jail in lieu of $500 bail. Probst is to return to the Le Roy Town Court on December 20, 2018 to answer to the charge. 18 year old, James O. Boughton of Chili Riga Center, Churchville NY was arrested on December 10, 2018 by the LeRoy Police Department and charged with Unlawful Possession of Marihuana and Disobeying a Traffic Control Device, both violation level offenses. While on patrol members of the LeRoy PoliceDepartment allegedly observed the vehicle operated by Boughton pass through a red signal. Patrols executed a lawful traffic stop on Boughton’s vehicle, identified Boughton as the operator, and after a brief investigation found Boughton to be in possession of a quantity of marijuana. Boughton was issued tickets and is to appear in the LeRoy Town Court on January 17, 2019 to answer to the charges.
