It is a restriction placed on the states. Historically, and even in the 20 th century, governments with standing armies, i.e., militia, would often remove weapons from their citizens. Then, when citizens had a grievance, and caused a disturbance to have their grievance addressed, the militia would be used to slaughter the country’s own citizens. The 2 nd amendment was intended to prevent those slaughters from happening in the United States. Article 1, Section 8 of the US Constitution establishes an expectation there will be a militia for the US Congress to call up. In New York State, the militia includes not only the National Guard, but also the NYS State Troopers, the city police and the county sheriffs. The 2nd amendment reaffirms that expectation with, “ A well regulated Militia, being necessary to the security of a free State, …” .* The amendment then states the restriction placed on the state if it created a militia, “…the right of the people to keep and bear Arms, shall not be infringed. ” * Your right to protect yourself, your family, and your neighbor if necessary is a 9 th amendment right. Your power to bear arms and use deadly force, if and when necessary, is a 10 th amendment power we never gave up. The 10 th amendment reflects on the 2 nd amendment restriction. “The powers not delegated to the United States by the constitution, nor prohibited by it to the states , are reserved to the states respectively, or to the people.” * In 1911, with the enactment of the Sullivan act, NYS began its tyrannical violation of the 2 nd amendment. When I am your Assemblyman, I will work to end this tyranny, and restore our constitutional values, i.e., our 9 th amendment rights and our 10 th amendment powers. (Roe v Wade, 1973) Society instantly turned its back on the newborn infants. They were placed on a shelf and abandoned. NYS law prevented even the doctors and nurses from caring for these babies. Nurses cried and babies died. When the NYS Legislature failed to act, doctors developed new techniques, insuring the fetus, the live baby inside a mo ther’s womb , died. The procedure came to be called an “abortion”. The US Supreme court did not sanction the slaughter of babies - not inside and not outside the woman’s womb. Our laws have minimized the visibility of the slaughter taking place. But the count is in the millions per year. The fact is Abortion is an act of abandonment when the child is most vulnerable. Abortion means the deliberate death of the child. It is murder. It is an act of tyranny sanction by the state. Women should have the Pro-choice right to choose when to terminate their pregnancy. Pro-life is a focus on the health and care of the mother, both before and after the termination of the pregnancy, and the care of the baby after the pregnancy is terminated. Pro-life is not just ‘anti - abortion’. Our laws should reflect a respect for human life. “We should be harvesting babies, not body parts.” When I am your Assemblyman, I will work to end this tyranny. I will work to make New York State a pro-choice, pro-life state.
