At its last June meet- ing, the Town Board authorized me to enter into a PILOT (pay- ment in lieu of taxes) with De- Paul Properties, Inc, a not-for- profit organization, with their project to construct a sixty (60) unit apartment complex on Mill St. (the former Lapp Lumber) in the village. There are a number of items to understand about PI- LOTs in general and this project in particular. I hope I do both justice in this column. This PILOT is a first for the Town (by law, villages are not allowed to enter into such agree- ments). Typically, any PILOTS in LeRoy go through the Gen- esee County Economic Devel- opment Center (GCEDC). That is because GCEDC can autho- rize both property tax exemp- tions and sales tax exemptions. However, DePaul, being not- for-profit, all ready has sales tax exempt status and a town may grant a property tax exemption itself. Most PILOTs (at least those that have been granted by GCEDC for LeRoy) are for commercial projects. These types of projects grow the tax base, potentially add/keep jobs, and do not require the services that residential projects do. This PILOT calls for De- Paul to pay the Town $18,000 per year (once certificate of occupancy is issued), adjusted annually by CPI, for the next thirty (30) years. In 2016, the property DePaul purchased yielded less than $13,500 in total tax revenue. Addition- ally, DePaul will, over the same thirty (30) year period, make an annual payment to both Le- Roy Fire District and LeRoy Ambulance Service of $3,000 to support emergency services that may be needed on site. At least fifty (50) of the sixty (60) apartments will be available to tax credit eligible tenants and at least one individual on the lease (for all units) must be at least fifty-five (55) years of age. In sum, this will be a senior citizen housing complex for those with lesser incomes. While there are always some reservations in the con- sideration of any PILOT, the benefits on this project seemed to far outweigh the reservations: 1. The reputation/quality of DePaul Properties, Inc.- I had the chance to visit one of their other sites- first class 2. The support of the LeRoy Village Board and County Legislator 3. Replacing the eyesore that is there now 4. The location of the proj- ect- checks all the boxes for character of existing neighbor- hood (an actual improvement), walkability to downtown, etc. 5. Town Board members could actually picture one or more senior LeRoyans they knew who might become residents 6. DePaul’s annual additional payments to ambulance/fire 7. Receiving more annual tax revenue than what we were re- ceiving from the current prop- erties’ conditions (guaranteed) The Board met w/ DePaul representatives several times and with the Village Board and County Legislator as well in considering this PILOT. We be- lieve this project will advantage the neighborhood itself, com- munity as a whole, and disad- vantage no one.
